ProGig Technologies Inc. ("ProGig," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform. When you create an account or use the Platform, we may collect:

  • Organization information: business name, description, location, service areas, and specialty details.
  • Payment information: billing address and payment method details (processed and stored by Stripe; we do not store full credit card numbers).
  • Communications: messages sent through the Platform, support requests, and feedback.

Usage Data

We automatically collect certain information when you access the Platform, including:

  • IP address, browser type, and operating system.
  • Pages visited, time spent on pages, and navigation paths.
  • Device identifiers and general location information derived from IP address.
  • Referring URLs and search terms used to find the Platform.

2. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve the Platform and its features.
  • Process transactions and manage your subscription.
  • Authenticate your identity and secure your account (via Clerk).
  • Send transactional emails (booking confirmations, payment receipts, account updates).
  • Respond to your support requests and inquiries.
  • Analyze usage trends to improve user experience and Platform performance.
  • Enforce our Terms of Service and prevent fraud or abuse.
  • Comply with legal obligations.

3. Legal Basis for Processing (GDPR)

If you are located in the European Economic Area (EEA), we process your personal data based on the following legal grounds:

  • Contract performance: processing necessary to provide you with the Platform services you requested (account management, subscriptions, bookings).
  • Legitimate interests: processing necessary for our legitimate business interests (analytics, fraud prevention, Platform improvement) where those interests do not override your fundamental rights.
  • Consent: where you have provided explicit consent for specific processing activities (e.g., marketing communications, non-essential cookies).
  • Legal obligation: processing necessary to comply with applicable laws and regulations.

4. Data Sharing & Third Parties

We do not sell your personal information. We may share your data with the following categories of third-party service providers:

  • Stripe: payment processing and subscription management. Stripe's privacy policy governs their handling of your payment data.
  • Clerk: authentication and identity management. Clerk processes your login credentials and session data.
  • Cloudflare (R2): media storage for profile images and uploaded files.
  • Resend: transactional email delivery.
  • Sentry: error tracking and performance monitoring (may receive anonymized usage data).
  • Axiom: log management and observability.
  • Vercel: web application hosting and analytics.

We may also disclose your information if required by law, court order, or governmental authority, or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others.

5. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you services. If you delete your account, we will delete or anonymize your personal data within thirty (30) days, except where we are required to retain it for legal, accounting, or regulatory purposes.

Payment records and transaction history may be retained for up to seven (7) years to comply with Canadian tax and financial reporting requirements.

6. Your Rights

Under PIPEDA (Canada)

As a Canadian resident, you have the right to:

  • Access your personal information held by ProGig.
  • Request correction of inaccurate or incomplete information.
  • Withdraw consent for the collection, use, or disclosure of your personal information (subject to legal or contractual restrictions).
  • File a complaint with the Office of the Privacy Commissioner of Canada.

Under GDPR (European Economic Area)

If you are located in the EEA, you additionally have the right to:

  • Right of access: obtain a copy of your personal data.
  • Right to rectification: correct inaccurate or incomplete data.
  • Right to erasure: request deletion of your personal data ("right to be forgotten").
  • Right to restriction: request restriction of processing in certain circumstances.
  • Right to data portability: receive your data in a structured, machine-readable format.
  • Right to object: object to processing based on legitimate interests or direct marketing.

8. International Data Transfers

Your information may be transferred to and maintained on servers located outside of your province, state, or country, where data protection laws may differ. Our primary infrastructure is hosted in Canada and the United States.

For transfers from the EEA, we rely on Standard Contractual Clauses (SCCs) approved by the European Commission, or other legally recognized transfer mechanisms, to ensure your data receives an adequate level of protection.

9. Children's Privacy

The Platform is not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected personal data from a child under 18, we will take steps to delete that information promptly.
